Terms of Service

These Terms of Service govern the marine services and online merchandise provided by Seahorsepower Performance. By submitting a booking request, placing an order, or accepting our services, you agree to the terms below. Please read them carefully.

Service Requests & Bookings

  • Submitting a booking request does not create a service contract.
  • A service agreement is formed only when Seahorsepower Performance reviews, accepts, and confirms the requested work.
  • Booking requests do not guarantee availability.
  • Seahorsepower Performance reserves the right to decline, reschedule, or terminate service at its discretion.

Estimates & Pricing

  • Estimates are based on the information available at the time they are provided.
  • Estimates may change after a vessel inspection.
  • Additional labour, diagnostics, repairs, or parts may be required if hidden defects or additional issues are discovered.
  • Marine systems frequently contain hidden defects that cannot be identified until work begins.

Payment Terms

Invoices are due upon receipt unless otherwise stated in writing.

Seahorsepower Performance reserves the right to suspend further work, recommendations, reports, documentation, scheduling, or future services until outstanding balances are resolved, where permitted by law.

Any applicable late payment charges shall be governed by the terms stated on the estimate, invoice, or service agreement.

Unforeseen Conditions

Marine vessels may contain hidden defects, corrosion, previous repairs, modifications, access limitations, or other unforeseen conditions that are not visible during initial assessment.

Additional labour, diagnostics, materials, repairs, or parts required due to unforeseen conditions are not included in initial estimates and may be billed separately upon customer approval.

Seahorsepower Performance reserves the right to revise the scope of work, pricing, or recommendations if required due to safety concerns, vessel condition, regulatory or compliance requirements, or newly discovered issues.

Customer Responsibilities

Customers are responsible for:

  • Providing accurate vessel information
  • Providing accurate contact information
  • Providing accurate booking form information
  • Providing safe access to the vessel
  • Providing keys, lock combinations, or access instructions where necessary
  • Obtaining marina permission if required
  • Ensuring a safe working environment

Customers are responsible for ensuring all information submitted through the booking form is accurate and complete. Seahorsepower Performance is not responsible for delays, scheduling issues, estimate revisions, or additional charges resulting from inaccurate or incomplete information.

Access Delays & Scheduling

Additional labour charges may apply if work is delayed by:

  • Inaccessible vessels
  • Missing keys
  • Locked compartments
  • Unavailable shore power
  • Marina restrictions
  • Vessel relocation
  • Customer scheduling issues
  • Inaccurate information supplied by the customer

If a technician arrives at the scheduled service location and work cannot proceed due to inaccessible vessels, missing keys, absent owners, unsafe conditions, lack of required permissions, marina restrictions, or inaccurate customer information, diagnostic, travel, labour, and scheduling charges may still apply.

Scheduling may also be affected by:

  • Weather
  • Marina restrictions
  • Parts availability
  • Vessel access limitations
  • Safety concerns

Missed Appointments

Customers are responsible for ensuring that the vessel is accessible at the scheduled service time.

If a scheduled appointment cannot proceed due to customer absence, inaccessible vessels, missing keys, lack of authorization, inaccurate booking information, marina restrictions, unsafe conditions, or other circumstances beyond the reasonable control of Seahorsepower Performance, diagnostic, travel, labour, and scheduling charges may apply.

Customer-Supplied Parts

Parts supplied by the customer are installed entirely at the customer's risk. Seahorsepower Performance provides no warranty on customer-supplied parts and is not responsible for:

  • Defective parts
  • Incorrect parts
  • Incompatible parts
  • Manufacturing defects
  • Delays resulting from customer-supplied parts
  • Additional labour resulting from customer-supplied parts

Labour charges may still apply even if customer-supplied parts fail, do not fit, or require replacement.

Communications Consent

By submitting a booking request, customers consent to receiving communications from Seahorsepower Performance by telephone, email, or text message regarding:

  • Estimates
  • Scheduling
  • Service updates
  • Invoices
  • Appointment reminders
  • Customer service matters
  • Follow-up communications relating to requested services

Emergency Service Disclaimer

Website submissions are not monitored continuously.

Customers requiring urgent assistance should contact Seahorsepower Performance directly by telephone. Emergency response availability is not guaranteed.

Right to Refuse Service

Seahorsepower Performance reserves the right to decline, suspend, terminate, or reschedule service where safety, regulatory, operational, scheduling, vessel condition, customer conduct, access limitations, or other legitimate business considerations reasonably require it. Examples may include:

  • Unsafe working conditions
  • Dangerous or unstable vessels
  • Inaccessible vessels
  • Regulatory or compliance concerns
  • Harassment, threats, or abusive conduct
  • Lack of required permissions or authorizations
  • Conditions that may endanger personnel, customers, property, or the vessel

Nothing in these Terms obligates Seahorsepower Performance to perform work that it reasonably determines cannot be completed safely, legally, or professionally.

Workmanship Warranty

Unless otherwise stated in writing, Seahorsepower Performance provides a limited workmanship warranty on labour performed. Warranty coverage does not apply to:

  • Customer-supplied parts
  • Manufacturer defects
  • Abuse
  • Neglect
  • Improper operation
  • Unauthorized repairs
  • Unauthorized modifications
  • Conditions outside Seahorsepower Performance's control

Specific warranty periods may be outlined on estimates, work orders, or invoices.

Online Store & Merchandise

Merchandise offered through our online store is sold subject to availability. Items may be released in limited quantities and may sell out. We reserve the right to limit quantities, correct errors, and decline or cancel any order — including for pricing errors, suspected fraud, or stock issues — and to refund any amount already charged in such cases.

Product images and descriptions are provided as accurately as possible; actual colours, sizing, and finish may vary slightly. Checkout, payment, and order fulfilment are handled through Shopify, and Shopify's terms apply to the checkout process.

Shipping. Orders are processed and shipped after payment is confirmed. Delivery timeframes are estimates and are not guaranteed. Shipping costs, if any, are shown at checkout.

Returns & Refunds. Eligible merchandise may be returned within 30 days of delivery, provided it is unworn, unwashed, and in original condition with any tags attached. Customers are responsible for return shipping unless the item arrived defective or incorrect. Approved refunds are issued to the original payment method. Certain items may be marked final sale, in which case this will be noted at the time of purchase.

Testimonials & Reviews

Customers may voluntarily provide reviews, testimonials, feedback, photographs, or other content relating to services performed.

By voluntarily submitting such content, customers grant Seahorsepower Performance permission to display and use that content for marketing, portfolio, promotional, and website purposes, unless otherwise requested in writing.

Limitation of Liability

To the maximum extent permitted by applicable law, Seahorsepower Performance shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, economic, or business losses arising from the use of the website, booking platform, estimates, recommendations, services, repairs, inspections, diagnostics, customer-supplied parts, or merchandise. This includes, but is not limited to:

  • Vessel downtime
  • Loss of use
  • Loss of enjoyment
  • Missed trips or events
  • Lost charter revenue
  • Lost business opportunities
  • Lost profits
  • Business interruption
  • Additional transportation or accommodation expenses
  • Third-party claims

Customers acknowledge that marine vessels are complex systems and that repairs, diagnostics, maintenance, and recommendations are performed based upon information reasonably available at the time of service.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law. Any liability of Seahorsepower Performance shall be limited to the maximum extent permitted by applicable law.

Intellectual Property

The following are the exclusive property of Seahorsepower Performance:

  • Business name
  • Logos and branding
  • Website content
  • Images, graphics, and videos
  • Written content
  • Merchandise designs

No material may be copied, reproduced, distributed, or used without written permission.

Governing Law

These Terms of Service shall be governed by and interpreted in accordance with:

  • The laws of the Province of Ontario
  • The applicable laws of Canada
